OUR HUNTING AGREEMENT

THIS HUNTING AGREEMENT is between [Jared Longbotham](“JP”), J-Rock Enterprises Inc. (“J-Rock”), and the hunter on the signature page (“you”) as the date on the signature page.

Background:  You are a licensed Texas hunter who has taken all the required Texas safety training and want to hunt on lands arranged by JP and J-Rock (the “Hunting Lands”).  JP is a hunting guide and J-Rock is a land agent for various landowners in Texas (the “Landowners”).  JP agrees to providing guide services and J-Rock agrees to provide land access as long as you follow the terms and conditions in this Hunting Agreement.

Firstly, JP will provide you with guide services and access to hunting equipment (the “Equipment”) during your hunt. In exchange, you can opt to pay the lease payment in two payments. The first payment of 50% of the total will be due to hold your reservation. The remaining 50% of the payment will be due on the day of your hunt before you begin hunting. As far as payments for the hunts go, we can be as flexible as possible and we feel everything is negotiable to an extent. However, if you do not make the payments, you will not be allowed to hunt. Secondly, you agree to not go onto the Hunting Lands without JP or an agent authorized by JP; you agree to not break any applicable federal, state, or local law, rule or regulation; you agree to not possess alcohol, illegal drugs, or any unlawful substance while on the Hunting Lands; you agree to not cause any damage to the Equipment (other than normal wear and tear) during the time you are on the Hunting Lands.

Thirdly, you agree that you are hunting at your own risk and that hunting and other nature and outdoor activities can be dangerous activities.  You also agree that either JP or an affiliate or agent can order you removed from the Hunting Lands for violating the terms of this Hunting Agreement.

Lastly, YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS JP, J-ROCK, THE LANDOWNERS, AND ALL OF THEIR EMPLOYEES, OWNERS, DIRECTORS, SHAREHOLDERS, AGENTS, AND GUIDES (THE “INDEMNIFIED PARTIES”) FROM ANY LOSSES, DAMAGES, LIABILITIES, OR CLAIMS OF ANY KIND, INCLUDING WITHOUT LIMITATION REASONABLE ATTORNEYS’ FEES, CONSEQUENTIAL DAMAGES, AND FINES ("CLAIMS"), WHICH MAY BE SUFFERED BY OR BROUGHT AGAINST ANY OF THE INDEMNIFIED PARTIES AS A CONSEQUENCE OF, IN CONNECTION WITH, OR RESULTING FROM YOUR HUNTING UNDER THIS AGREEMENT, OTHER THAN CLAIMS ARISING FROM OR ATTRIBUTABLE TO THE GROSS NEGLIGENCE AND/OR WILLFUL MISCONDUCT OF ONE OF THE INDEMNIFIED PARTIES.  This indemnification is in addition to, and not in limitation of, the liability limitations provided under Texas Civ Practice and Remedies Code Chapter 75, LIMITATION OF LANDOWNERS' LIABILITY or Chapter 75A, LIMITED LIABILITY FOR AGRITOURISM ACTIVITIES.

This Hunting Agreement is governed by Texas law and you agree to venue in Howard County, Texas for any dispute under this agreement.
